Welcome to Plus.BigDeal.sg. By using this website (the “Site”), you (or “User”) agree to the terms and conditions that we (“Plus! BigDeal” or “Plus! BigDeal Pte. Ltd.”) have provided on the Site. If you do not agree to these terms, you must cease use of the Site immediately.

General

Plus! BigDeal may change the Terms of Use and/or our Privacy Policy from time to time and at any time, and without actual notice to you. All such changes to these Terms of Use will appear on Plus.BigDeal.sg. If you continue to use the Site after we have made changes to our Terms of Use and Privacy Policy, you are implied to have agreed to the Terms of Use and PrivacyPolicy expressed herein.

The Site may be unavailable from time to time for any reason. You understand and acknowledge that due to circumstances both within and outside of the control of Plus! BigDeal access to the Site may be interrupted or suspended from time to time or permanently terminated. Plus! BigDeal shall have the right at any time to change or discontinue any aspect or feature of Plus! BigDeal with or without giving notice to you.

Nothing in these Terms of Use creates or be deemed to create a partnership, employment relationship or agency between Plus! BigDeal and Users or between Plus! BigDeal and Merchants. There are no third-party beneficiaries of these Terms of Use. You may not assignthese Terms of Use, in whole or in part, to any third party without our prior written consent, and any attempt by you to do so will be invalid. Should any term of these Terms of Use be held invalid or unenforceable in any jurisdiction, that invalid or unenforceable term shall not affect the remaining terms which will remain in full force and effect. Our failure to enforce any term of these Terms of Use will not be considered a waiver of the right to enforce such term. Ourrights under these Terms of Use will survive any termination of these Terms of Use.

These Terms of Use, together with the Privacy Policy and any other legal notices published by Plus! BigDeal on the Site from time to time, shall constitute the entire agreement between you and Plus! BigDeal concerning the Site. For avoidance of doubt, the aforesaid does not preclude Plus! BigDeal from imposing any other terms and conditions on a Deal and/or a Coupon.

YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SITE MUST COMMENCE WITHIN SIX (6) MONTHS AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

You affirm that you are either 18 years of age or above, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations,affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use.

General Rules of User Conduct

We aim to make the use of our Site a positive experience for all of our Users, so we require that User restrict any and all activity in connection with the use of this Site to lawful purposes only. User shall not post or transmit through this Site any material which violates or infringes in any way upon the rights (intellectual property right or otherwise) of others, or any material which is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without Plus! BigDeal express prior, written approval, contains advertising or any solicitation with respect to any products or services. Any conduct by a User that in our exclusive discretion restricts or inhibits any other User from using or enjoying this Site is strictly prohibited. User agrees not to attempt to reverse engineer or jeopardize the correct functioning of the Site, or otherwise attempt to derive the source code of the software (including the tools, methods, processes, and infrastructure) that enables or underlies the Site. User must not upload or transmit any form of virus, worm, Trojan horse, or other malicious code.

Any communications you posted on this Site or otherwise to us by electronic mail are made on non-confidential and non-proprietary basis, we shall be free to use the content of any such communications, including ideas, inventions, concepts, techniques or know-how disclose therein, for any purpose, including improving and marketing this Site.

The foregoing terms of this section apply equally to and are for the benefit of Plus! BigDeal, its subsidiaries, affiliates and its third party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.

Plus! BigDeal’s Proprietary Rights

All materials contained in this Site, including, but not limited to images, illustrations, audio clips, and video clips, are the copyrighted property of Plus! BigDeal Pte. Ltd. or by other parties that have licensed their material to Plus! BigDeal. As between Plus! BigDeal and you, Plus! BigDeal is the sole owner of all content on the Site, including without limitation, all applicable copyrights, trademarks, designs, trade names and trade secrets, source codes, prototypes, digital files, URLs and other intellectually property rights thereto. Any copying, reproducing, distributing, transmitting, posting, linking, deep linking, or otherwise modifying of this Site without the express written permission of Plus! BigDeal Pte.Ltd. is strictly prohibited. Modification of the materials or use of the materials for any other purpose is a violation of the copyrights and other proprietary rights.

Plus! BigDeal relies upon independent Merchants who advertise or promote their respective goods and services through the Site. We shall not be liable for any infringement of copyrights, trademarks, trade dress or other proprietary or intellectual property rights arising out of content posted on or transmitted through the Site, or items advertised on the Site, by the Merchants. Plus! BigDeal reserves the right but not obligation to remove any advertisement or promotion that infringes intellectual property right or violates any law or is inappropriate in the opinion of Plus! BigDeal from the Site at any time.

Terms of Sale

The Site provides Users with opportunities to experience products and services from businesses at a discount (a “Deal”).

By placing an order for a Deal on the Site, you make an offer to Plus! BigDeal to purchase the Deal you have selected on the terms, restrictions and conditions associated (by whatever name called) with the Deal, subject to the Initial Requirements for that Deal being met. You acknowledge that Plus! BigDeal has the right but not the obligation to set the Initial Requirements for a Deal. A Deal is not sold until we notify you via email that the requisite Initial Requirements have been met. Once a Deal is sold to you, a coupon which gives you the right to redeem the goods or services stated in the Deal (“Coupon”) will be sent to your Plus! BigDeal account and/or email address. The Coupon you purchased is redeemable for goods or services by the seller of such goods and services, hereinafter defined as "Merchant". The Merchant, not Plus! BigDeal, is the seller of the goods and services and is solely responsible for redeeming any Coupon you purchased in all respect including but not limited to the satisfactory quality, merchantability and fitness of the goods or services. For further details ofwarranties, please refer to ‘Disclaimer of Warranties’ below.

For the purposes of this Terms of Use, Initial Requirement means the minimum requirement set by Plus! BigDeal for a Deal.

You are required to create an account with Plus! BigDeal in order to purchase any Deal. This is required for us to provide you with easy access to print your Coupon(s), view your past purchases and credits earned and modify your preferences.

In addition to the specific terms listed for each Deal, the terms stated in the Terms of Use applies to all Deals, unless explicitly stated otherwise.

Coupon

Unless otherwise stated, a Coupon cannot be used in conjunction with other coupons, discounts, gifts, happy hour promotion or other special offers. A Coupon cannot be applied toward the payment of shipping fees, tips or gratuities, taxes, or outstanding balances owed to Plus! BigDeal or Merchants. A Coupon must be redeemed in one (1) visit. No cash back orcompensation in kind for partial redemption. Neither Plus! BigDeal nor the Merchant is responsible for lost or stolen Coupon or Coupon's unique reference number. Reproduction, sale or trade of a Coupon is strictly prohibited. Any redemption of a Coupon not consistent with these terms and conditions will render the Coupon null and void to the extent prohibited by law.

The Merchant shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, User or Coupon holder, caused in whole or in part by the Merchant, as well as for any unclaimed property liability arising from unredeemed Coupons.

Refund Policy

Unless otherwise specified under the relevant consumer protection law or in a Deal or Coupon, Plus! BigDeal may at its sole discretion refund to a User wholly or partly the price that the User paid to Plus! BigDeal for a Coupon less any applicable bank and administrative charges for an unredeemed Coupon upon written request from the User (“Refund Request”). The Refund Request must be submitted together with the unredeemed Coupon. Plus! BigDeal strictly does not allow a refund of any amount where the Coupon was for an one-time event and the event date has passed.

Plus! BigDeal does not assume any liability for any payment such as airport taxes or administrative fees made directly to Merchant or any other third party.

Accuracy of Content and Limitations on Quantity

The information on the Site may contain typographical errors, pricing errors, and other errors or inaccuracies. Errors will be corrected as soon as practicable. We reserve the right to: (i)revoke any stated offer; (ii) correct any errors, inaccuracies or omission; and (iii) make changes to prices, content, promotion offers, product descriptions or specifications, or other information at any time without obligation to issue any notice of such changes (including after an order has been submitted, acknowledged, shipped or received). We also reserve the right to limit quantities (including after an order has been submitted and/or acknowledged) and to revise, suspend or terminate an event, promotion at any time without notice. The inclusion of any products or services on the Site at a particular time does not guarantee that the products or services will be available.

Linked Sites

You may be able to link to third parties' web sites ("Linked Sites") from the Site. Linked Sites are not, however, reviewed, controlled, or examined by Plus! BigDeal in anyway and Plus! BigDeal is not responsible for the content, availability, advertising, products or other materials of any such Linked Sites, or any additional links contained therein. These links do not imply Plus! BigDeal’s endorsement of, association, partnership or any other relationship with the Linked Sites with their operators. It is your sole responsibility to comply with the terms of service and privacy policy of the Linked Sites as well as with any other obligation under copyright, secrecy, defamation, decency, privacy, security and export laws related to the use of such Linked Sites and any content contained there on. In no event shall Plus! BigDeal be liable, directly or indirectly, to anyone for any loss or damage arising from or occasioned by the creation or use of the Linked Sites or the information or material accessed-through these Linked Sites. You should direct any concerns to that site's administrator or webmaster. Plus! BigDeal reserves the exclusive right, at its sole discretion, to add, change, decline or remove, without notice, any link to any of the Linked Sites from the Plus! BigDeal Site and/or introduce different links to different users.

Privacy

You acknowledge and agree that Plus!BigDeal may preserve information and content and may also disclose information and content if required to do so by law or believe in good faith that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms of Use; (c) respond to claims that any information or content violates the rights of third parties; or (d) protect the rights, property, or personal safety of Plus! BigDeal, its Users or the public.

Our Privacy Policy which is available here is specifically incorporated by reference into this Terms of Use.  By using of this Site, you agree to be bound by the Privacy Policy and to the use of your personal information in accordance with our Privacy Policy.

Disclaimer of Warranty

YOU AGREE THAT YOUR USE OF THIS SITE SHALL BE AT YOUR SOLE RISK. THIS SITE AND THE LINKED SITES ARE MADE ACCESSIBLE ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IN RESPECT OF A DEAL, PRODUCT OR SERVICE), AND PLUS! Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, THIS LIMITATION OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTERVIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESSTO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. USER SPECIFICALLY ACKNOWLEDGES THAT PLUS! BIGDEAL IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH USER.

IN NO EVENT SHALL PLUS! BIGDEAL, OR ANY PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING THIS SITE OR THE CONTENTS HEREOF, INCLUDING THE LINKED SITES AND ANY SOFTWARE, BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF ORINABILITY TO USE THIS SITE, WHETHER OR NOT PLUS! Indemnification

User agrees to defend, indemnify and hold harmless Plus! BigDeal, its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of this Site and/or the Linked Sites by the User.

Notices to you

You agree that Plus! BigDeal may provide you with notices via email, telephone, SMS or posting on this Site. 

Copyright Infringement Notice and Take Down Procedures

If you are a copyright owner or an agent thereof and believe that the content residing or accessible on the Site infringes a copyright, you may submit a notification pursuant to the Copyright Act (Chapter 63) of Singapore by providing a Copyright Infringement Notice with the following information in writing to our Designated Representative at support@plusbigdeal.sg.:

(i)                Identify the copyrighted material claimed to have beeninfringed; and

(ii)              locate the electronic copy of the copyrighted material;

After our Designated Representative receives notification of an alleged infringement in the above prescribed manner, we may disable access to or remove the electronic copy of material from the Site.

Termination

We may change or discontinue the Site at any time without prior notice. We reserve the right to terminate these Terms of Use at our election and for any reason, without prior notice, and theseTerms of Use will automatically terminate in the event that you violate any of the terms and conditions set forth below. In the event of any termination, you will immediately cease access to the Site.

Governing Law and Jurisdiction

The validity, interpretation and legal effect of this Terms of Use shall be governed by, and construed in accordance with, the laws of Singapore.  You agree to submit to the non-exclusivejurisdiction of the Singapore Courts in respect of any disputes relating to this Terms of Use.
